Privacy Policy
The SmallBizWorthy.com (SBW) Web site is an interactive on-line service provided by SmallBizWorthy, Inc. (SBW INC.), and offers a variety of services, from e-commerce to information about revenue building opportunities. SmallBizWorthy.com is a service of SBW Inc., and offers information and services relating to the creation, financing, management, marketing and management of middle market businesses. The information and services that are available on or that are provided by SmallBizWorthy.com may come from third parties.
Although SBW INC. respects the privacy of all those who visit this Site and use our services, we do collect information from our members and visitors. This Privacy Policy governs your interaction with this Site, and your registration for and use of SBW's online services. Except as set forth within this Privacy Policy and our Terms of Service and other published guidelines, we do not release personally identifiable information about our members and visitors without their permission.
Please note that SBW INC. reviews its privacy practices from time to time, and that those practices are therefore subject to change. The Information We Gather SBW INC. gathers two types of information about users:
(1) Non-personally identifiable information: When visitors come to this Site, we collect and aggregate information indicating, among other things, which pages were visited, the order in which they were visited, and which hyperlinks were "clicked." Collecting such information involves the logging of IP addresses, operating system and browser software used by each visitor to this Site. Although such information is not personally identifiable, we can determine from the IP address a visitor's Internet Service Provider and the geographic location of the visitor's point of connectivity.
We use this data to make decisions about the effectiveness of our Web site, our promotional activities. We do not knowingly collect personally identifiable information from children (minors under thirteen years old).
SBW INC. does not control the acts of its members or visitors. All members and visitors should be aware that, when they disclose personally identifiable information in a bulletin board, chat room, guestbook, or other forum or public area of this Site, the information may be collected and used by others for the purposes of distributing unsolicited communications to you or to others outside this Site. How We Use (and Do Not Use) the Information We Gather

How We Use (and Do Not Use) Non-Personally Identifiable Information
We use non-personally identifiable information in aggregate form to build higher quality, more useful online services by performing statistical analyses of the collective characteristics and behavior of our members and visitors, and by measuring demographics and interests regarding specific areas of this Site. We provide statistical information based on this data to advertisers, affiliates, and other current and potential business partners. We also use the aggregate data to inform these third parties as to the number of people who have seen and clicked on links to their web sites.
This Site contains links to other Web sites, including co-branded or other affiliated sites which may or may not be owned or operated by SBW INC. SBW INC. provides notice to potential SBW registrants that personal and business identifiable information will be collected during the registration process. Such notice is provided simultaneously with your SBW registration; moreover, this Privacy Policy itself serves as notice that such information is collected under those circumstances.
As part of the SBW registration process, you may choose to "opt in" to receive promotional materials not directly related to our services from SBW INC. and/or its affiliates, advertisers, or other business partners.
Contact
SBW INC. reserves the right to periodically contact you about third parties who provide goods or services that we believe may be of interest to you. If you wish to "opt-out" of that SBW INC. service, please send an email to us at 411@smallbizworthy.com with the subject line "Opt-Out". If there are features, subscriptions or products made available to you through the operation of the Site which require you to provide SBW with your credit card information, we will not release your credit card information to third parties unless necessary to complete a transaction between you and such third party.
We reserve the right to release information contained within our access logs concerning any visitor or member when that visitor or member who is in violation of our Terms of Service or other published guidelines, or partakes (or is reasonably suspected of partaking) in any illegal activity, even without a subpoena, warrant, or other court order, and to release such information in response to discovery requests. We cooperate with law enforcement agencies in identifying those who may be using our servers or services for illegal activities. We also reserve the right to report any suspected illegal activity to law enforcement for investigation or prosecution, or to suspect or terminate your membership in connection with any suspected illegal activity.
If and when SBW INC. sponsors promotions or sweepstakes, or third parties sponsor promotions or sweepstakes in conjunction with SBW INC., either SBW INC. or the third party will post relevant information in the official rules and/or registration area for the promotion or sweepstakes. That privacy information, to the extent it conflicts with this Privacy Policy, will govern for that particular promotion or sweepstakes.
Changing or Deleting Personal Information
If you would like to have your personally identifiable information removed from SBW's database, please contact us at 411@smallbizworthy.com, and we will use reasonable efforts to comply with your request. Corrections such as address changes and business profiles can be done via this Site using the "update profile" function or by sending an e-mail to 411@smallbizworthy.com. Keep in mind, however, that there will be residual information that will remain within SBW databases, access logs, and other records, which may or may not contain such personally identifiable information. The residual information will not be used for commercial purposes; however SBW INC. reserves the right, from time to time, to contact former customers or users of SBW INC.
Security
SBW INC. uses extensive and sophisticated secure technology to ensure that the data you send in connection with your registration remains confidential and secure. This site has security measures in place to protect the loss, misuse and alteration of the information under our control. All credit card information is encrypted for your protection. Although SBW INC. has taken these measures to ensure that your personal information is delivered and disclosed only to the appropriate parties in accordance with your instructions, we cannot and do not guarantee that the personal information you provide will not be intercepted by others and decrypted.

Miscellaneous
This Agreement and the resolution of any dispute related to this Agreement or this Site shall be governed by and construed in accordance with the laws of New Jersey, without giving effect to any principles of conflicts of law. Failure by SBW INC., or its affiliates to insist upon strict enforcement of any provision of this Agreement shall not be construed as a waiver of any provision or right. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of this Site or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
